- Term; Termination.
This Agreement may be terminated by either party without notice at any time for any reason. The provisions of paragraphs 1 (Copyright, Licenses and Idea Submissions), 2 (Use of the Service), 3 (Indemnification), 4 (Third Party Rights) and 6 (Miscellaneous) shall survive any termination of this Agreement.
- Miscellaneous.
This Agreement shall all be governed and construed in accordance with the laws of The United States of America applicable to agreements made and to be performed in The United States of America. You agree that any legal action or proceeding between LuluCartoon and you for any purpose concerning this Agreement or the parties’ obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in The United States of America . Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. LuluCartoons failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement.
LuluCartoon may assign its rights and duties under this Agreement to any party at any time without notice to you.
MESSAGING TERMS AND CONDITIONS
You agree to receive recurring automated marketing and informational text (e.g., SMS and MMS) messages from LULUCARTOONS, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when joining or any other number that you designate. Consent to receive automated marketing text messages is not a condition of any purchase. Msg & Data rates may apply.
Message frequency will vary. LULUCARTOONS reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. LULUCARTOONS also reserves the right to change the short code or phone number from which messages are sent.
Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. LULUCARTOONS, it service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages.
CANCELLATION
Reply STOP to cancel. After texting STOP you will receive one additional message confirming that your request has been processed. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not include the STOP keyword command and agree that LULUCARTOONS and its service providers will have no liability for failing to honor such requests. If you unsubscribe from one of our text message programs, you may continue to receive text messages from LULUCARTOONS through any other programs you have joined until you separately unsubscribe from those programs.
MOBILE PHONE NUMBER CHANGE
In the event that you change or deactivate your mobile phone number, you agree to notify LULUCARTOONS by emailing us at support@LuluCartoons.com.
